By downloading or using Richard Buckingham’s apps or by accessing this website (collectively, “the Service”), these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the Service. You’re not allowed to copy, or modify any part of the Service, or my trademarks in any way. You’re not allowed to attempt to extract the source code of the apps, and you also shouldn’t try to translate the apps into other languages, or make derivative versions. The Service, and all trademarks, copyright, database rights and other intellectual property rights related to it, still belong to Richard Buckingham.
Richard Buckingham is committed to ensuring that the Service is as useful and efficient as possible. For that reason, I reserve the right to make changes to the Service or to charge for services, at any time and for any reason. I will never charge you for the Service without making it very clear to you exactly what you’re paying for.
Age Restrictions and Parental Consent
Some of my apps may be suitable for children. If you are under 18 years of age (or the age of majority in your jurisdiction), you must have your parent or guardian’s permission to use the apps and make any in-app purchases. By using the apps, you represent that you either are at least 18 years old, or that you have your parent or guardian’s consent to use the apps.
In-App Purchases
Some apps may offer in-app purchases for additional features, such as removing advertisements or unlocking premium content. All purchases are processed through the relevant app store (such as Apple’s App Store) and are subject to that platform’s terms and conditions regarding purchases and refunds. Purchases are final unless otherwise required by applicable law or the app store’s refund policy.
Data and Privacy
The apps may store and process personal data that you have provided to me, in order to provide my Service. It’s your responsibility to keep your phone and access to the apps secure. I therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the apps won’t work properly or at all.
Network Connectivity and Data Charges
You should be aware that there are certain things that Richard Buckingham will not take responsibility for. Certain functions of the apps will require an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Richard Buckingham cannot take responsibility for the apps not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.
If you’re using the apps outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the apps, or other third party charges. In using the apps, you’re accepting responsibility for any such charges, including roaming data charges if you use my apps outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the apps, please be aware that I assume that you have received permission from the bill payer for using the apps.
Liability and Service Availability
Richard Buckingham cannot take responsibility for how you use the apps or for device-related issues that prevent you from accessing the Service. When you’re using the apps, it’s important to bear in mind that although I endeavour to ensure that they are updated and correct at all times, I do rely on third parties to provide information to me so that I can make them available to you.
To the maximum extent permitted by applicable law, Richard Buckingham accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the apps. This includes, but is not limited to, any loss of data, revenue, or profits, or any other commercial damages or losses.
App Updates and Termination
At some point, I may wish to update the apps. The apps are currently available on iOS – the requirements for iOS (and for any additional systems I decide to extend the availability of the app to) may change, and you may need to download the updates if you want to keep using my apps. Richard Buckingham does not promise that he will always update the apps so that they are relevant to you and/or work with the iOS version that you have installed on your device. Please note that failing to install updates when offered may result in reduced functionality or apps that no longer work properly. I may also wish to stop providing the apps, and may terminate use of them at any time without giving notice of termination to you. Unless I tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
Third-Party Services
The apps integrate with third-party services including AdMob (for advertising), Firebase (for analytics), and Apple Game Center (for achievements and leaderboards). Your use of these services is also subject to their respective terms of service and privacy policies. I am not responsible for the terms, policies, or practices of these third-party services.
Governing Law and Disputes
These Terms and Conditions are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from or relating to these terms or your use of the apps shall be resolved in the Queensland courts, with jurisdiction in the Southport District Court or Magistrates Court as appropriate to the nature and value of the dispute. If any provision of these terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
Changes to These Terms and Conditions
I may update these Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. I will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.
